Court Concedes DNC, Wasserman Schultz Rigged Primaries For Hillary

“To the extent Plaintiffs wish to air their general grievances with the DNC or its candidate selection process, their redress is through the ballot box, the DNC’s internal workings, or their right of free speech — not through the judiciary,” Judge William Zloch, a Reagan appointee, wrote in his dismissal of the class-action lawsuit. “To the extent Plaintiffs have asserted specific causes of action grounded in specific factual allegations, it is this Court’s emphatic duty to measure Plaintiffs’ pleadings against existing legal standards. Having done so ... the Court finds that the named Plaintiffs have not presented a case that is cognizable in federal court.”

But wait, what else did our esteemed Judges say?

“In evaluating Plaintiffs’ claims at this stage, the Court assumes their allegations are true — that the DNC and Wasserman Schultz held a palpable bias in favor Clinton and sought to propel her ahead of her Democratic opponent,” he wrote.

The Court thus assumes that the DNC and Wasserman Schultz preferred Hillary Clinton as the Democratic candidate for president over Bernie Sanders or any other Democratic candidate. It assumes that they stockpiled information useful to the Clinton campaign. It assumes that they devoted their resources to assist Clinton in securing the party’s nomination and opposing other Democratic candidates. And it assumes that they engaged in these surreptitious acts while publicly proclaiming they were completely neutral, fair, and impartial. This Order therefore concerns only technical matters of pleading and subject-matter jurisdiction."

Thanks for posting the Jimmy Dore interview, Alligator Ed.

Jared Beck makes it very clear that the judge did not make any findings of fact, and did not "concede" anything about the plaintiffs' claims.

This was strictly a procedural motion at the earliest stage of the lawsuit. Discovery (the evidence-gathering process) had not yet begun. Since no evidence had been presented or examined, the judge could not and did not make any findings of fact.

As Beck makes clear, what the judge meant was that he assumed for the sake of argument that plaintiffs' claims were true. This assumption is a required part of what a judge has to do when considering a procedural motion to dismiss.

Jimmy in contending that the lawsuit was a winner as soon as the DNC lawyer said, early on, that "the DNC need not run a fair primary, they can run their show any way they want." (or words to that effect). Just getting those futhermuckers to admit that in a court of law is a Yuuuuge win.

I've been wondering whether the DNC lawyer might have gotten into a bit of trouble for that. I'm sure he never expected anyone outside of the courtroom to hear about it. This was a hearing on a procedural motion (pretty boring!) in a low-profile case (because the MSM was not reporting on it).

Little did he know that the plaintiffs' lawyers would post online a copy of the hearing transcript, and that a lot of people would actually read it and talk about it, especially on social media.

It's a lawsuit, and this is an order written by a judge, and a lawyer (Jared Beck) talking about it, so there's going to be legal mumbo jumbo.

That's why the Clintons are not in jail, right?

They're not in jail because those whom they serve (the corporatist oligarchy, especially Wall Street and the MIC) don't want them to be in jail.

So they cheat and voting makes no difference in who they decide will win elections but:

Democracy is only a word used to con The People and fraud only counts as a crime where any of Those Who Matter are not advantaged by it...

Edit: and the fact that the judge thinks that everyone should assume that political parties are criminal cheaters shows his political awareness but is hardly reassuring, as there's no suggestion as to what to do about this...
